The following terms and conditions of sale govern the relationship between: VIRGILE HEALTH, 4 route d’Arques, 11190 Serres and customers wishing to place an order.
These terms and conditions of sale may be modified at any time by Virgile HEALTH. Special conditions for certain products or services may complement these general terms. They will be specified during the presentation of the item. The act of placing an order with Virgile Health implies the customer’s unconditional acceptance of these terms and conditions of sale. If a condition is missing, it would be considered to be governed by the practices in force in the sales sector.
The information given in catalogs, price lists, websites, etc. is provided for informational purposes only and may be modified by the seller without notice. The mere fact of placing an order or accepting an offer from the seller implies unconditional acceptance of these terms and conditions. These terms and conditions may be modified at any time and without notice by Virgile HEALTH, with the modifications then applicable to all subsequent orders.
Products are offered for sale until stock is exhausted. In case of an order for an unavailable product, the customer will be informed by email or phone call as soon as possible.
The prices shown on Virgile HEALTH price lists are expressed in Euros and are inclusive of all taxes (VAT), including packaging, ex-warehouse, excluding shipping costs. They may be modified at any time without notice. To this price, a shipping fee must be added, which depends on the country of delivery. This fee is specified at the end of the order form and is reminded in the order summary before validation. Any other destination will be studied on a case-by-case basis, prices are then net, all taxes included, packaging, transport and insurance costs not included. The price is payable in full on the day of the order. The prices applied are those in effect at the time of the order, subject to stock availability and typographical errors.
If the customer wishes to place an order, they must first identify themselves. For this purpose, they will fill out a form made available to them, according to the instructions provided, where they will enter the information necessary for their identification, including their name, first name, telephone number, postal and email address, and billing and delivery address. Additional information may be requested later to ensure the quality and security of the delivery. All information is presented to the customer in French. The data recorded by Virgile HEALTH constitutes proof of the nature, content and date of the order.
Delivery is made to the address specified by the customer when placing their order. It will be carried out by La Poste or by a carrier. It can only take place once the order has been validated by the customer and payment has been made in full. The bank payment centers concerned will therefore have given their payment agreement beforehand. In case of refusal by said centers, the order will be automatically cancelled. Furthermore, Virgile HEALTH reserves the right to refuse any order from a customer with whom there is an ongoing dispute.
It is the customer’s responsibility to carry out all verifications and make all reservations upon arrival of the material and to exercise, if necessary, all recourse against the carrier. In case of error in the order, the customer must notify Virgile HEALTH as soon as possible. They will then be offered to exchange the non-compliant product or to send the missing product if it is in stock, or a credit note to be used on their next order, or a refund for the missing product.
Virgile HEALTH reserves the right to request a bank check and/or proof of identity and/or proof of address from the Customer in case of significant amounts involved. Payment is made by bank transfer to the following email address: virgile?escalant@gmail.com
If the ordered item is available in stock, orders placed from Monday to Thursday are shipped at best within the following three days. For orders placed from Friday to Sunday, shipping is done the following Monday. The delivery time for packages is approximately 72 hours for metropolitan France with La Poste’s Colissimo service. Our goods travel at the risk of the recipient (even in case of prepaid shipping). Shipping costs are borne by our customers; non-delivery or delay cannot under any circumstances give rise to a claim for penalties or damages; cases of strike, fire accidents, lack of transport equipment, shortage of raw materials are considered as force majeure and result in the discharge of all damages and any liability whatsoever. Any cancellation of an order, regardless of the reason, and accepted by Virgile HEALTH will entitle the customer to a refund of the amounts paid only. No compensation related to this cancellation can be requested. The customer must verify the condition of the packages upon delivery and, in case of damage or missing products, specify their reservations on the delivery note and confirm them within three days of delivery by phone, mail, or email to Virgile HEALTH and by registered letter with acknowledgment of receipt addressed to the carrier itself. Any unclaimed and returned package may be reshipped at the recipient’s expense.
A detailed invoice can be sent by email or postal mail to the address requested by the customer.
From the delivery date of your order, if you are an individual, you have a period of 14 days to exercise your right of withdrawal and be fully refunded (including shipping costs) – the cost of returning the goods remaining your responsibility. However, incomplete, worn, damaged, or soiled products will not be accepted for return. The customer must obtain prior agreement from Virgile HEALTH before proceeding with the return of the goods. To exercise the right of withdrawal, the customer must notify their decision to withdraw from their order by an unambiguous written statement specifying their name and surname, email, address, order number and date:

Virgile HEALTH retains ownership of the goods until full payment is received from the customer. The transfer of ownership of the products to the customer takes place at the time of full payment of the price. Failure by the customer to fulfill their payment obligations, for any reason whatsoever, gives Virgile HEALTH the right to demand immediate return of the delivered goods at the expense, risk, and peril of the customer. The customer agrees, in the event of judicial reorganization proceedings affecting their company, to actively participate in establishing an inventory of goods in their stocks for which Virgile HEALTH claims ownership. Failing this, Virgile HEALTH has the option of having the inventory recorded by a bailiff at the customer’s expense. The customer is prohibited from reselling or processing the delivered goods from the date of the judgment pronouncing the judicial reorganization or liquidation of their Company’s assets. Virgile HEALTH may prohibit the customer from reselling or processing the goods in case of late payment. To guarantee payments not yet made and in particular the balance of the customer’s account in Virgile HEALTH’s records, it is expressly stipulated that the rights relating to delivered but unpaid goods will be transferred to identical goods from Virgile HEALTH in stock at the customer’s premises, without the need to allocate payments to a specific sale or delivery.
Personal data provided by the customer is not shared with third parties, except for the banking institution for payment security and insurance. In accordance with law 78-17 of January 6, 1978, the customer has the right to access and rectify their data at any time. To exercise this right, simply contact Virgile HEALTH. To meet fiscal and legal obligations, a paper and digital copy of each invoice will be kept by Virgile HEALTH for 12 years. In accordance with the Data Protection Act of January 6, 1978, you have the right to access, rectify, and oppose all of your personal data at any time.
The general terms of sale presented above are governed by French law. Any dispute concerning these general terms of sale will be submitted to the Commercial Court of Toulon only
The General Terms of Sale are subject to French law, unless otherwise provided by law.
In case of disputes, the Customer can first contact the Seller’s Customer Service to seek an amicable solution.
The Seller informs the Customer that it is a member of the National Association of Mediators (ANM).
After preliminary written steps by consumers towards the Seller, the mediator’s service can be called upon for any consumer dispute that has not been resolved. To learn about the procedures for referring to the Mediator, click here.
